Orders placed in the online shop on this website (hereinafter "Heimatkult.ch") are processed by Fulfillment.Swiss, Isenrietstrasse 19, 8617 Mönchaltorf.

These General Terms and Conditions apply to the use of this website and the online shop on this website, as well as to purchases made on Heimatkult.ch. By registering on this website and using it, as well as by using Heimatkult.ch, you accept these General Terms and Conditions.

If there are any differences between the German, French, or English versions of these General Terms and Conditions, the German version prevails.
Access to the Website and Password
This website and the online shop Heimatkult.ch are intended only for people over 18 years old who live in Switzerland or the Principality of Liechtenstein and want to buy hemp or tobacco products for personal use. To access this website, you have to prove your age. You also need to register and choose a username and password, which are meant for your personal use only. For your own security, you must not share these login details with anyone else. This is to prevent unauthorized third parties from using the website. As a user of this website and Heimatkult.ch, you are required to take all necessary steps to keep your username and password confidential.
You should let us know right away if you have any reason to believe someone else might have found out your username or password, or if there’s a risk your username and password could be used without your permission. Competition Terms
The competitions organized on Heimatkult.ch are only open to people over 18 years old who live in Switzerland.
Employees of Heimat Manufaktur AG, their partners and service providers, as well as the family members of these employees, are not allowed to take part in such competitions.
We also reserve the right to end a competition at any time at our own discretion. Stopping a competition does not entitle you to any kind of compensation. No rights are acquired and no services can be claimed.
We accept no liability if data entered in forms or emails from participants are not recognized by the system, or if someone is prevented from taking part in a competition due to a technical or other defect.
We also reserve the right to exclude participants from competitions. This especially applies to participants who cheat or try to cheat (for example, by creating multiple accounts), or to participants who violate the general or specific terms and conditions of a competition, or who misuse the competitions in any way.
All other provisions of these general terms and conditions also apply, especially those regarding access to the website, terms of use, warranty and liability disclaimers, and data protection.
Conclusion of a Purchase Contract
Heimat Manufaktur AG is responsible for selling goods ordered through Heimatkult.ch. So, when you place an order on Heimatkult.ch, you’re buying the goods from Heimat Manufaktur AG. Heimat Manufaktur AG is also in charge of preparing, delivering, and invoicing your orders.
Your order is your declaration that you want to buy goods. After your order comes in, you’ll get an order confirmation from Heimat Manufaktur AG letting you know your order was received. This confirmation isn’t an acceptance of your order. The order confirmation includes all the important info about your order. If the confirmation contains any incorrect info, you have to notify Heimat Manufaktur AG right away.
Heimat Manufaktur AG will let you know if they decide not to accept your order.
If Heimat Manufaktur AG becomes aware of a violation of these general terms and conditions in connection with a purchase on Heimatkult.ch, we reserve the right to block you from using and accessing this website and to delete your account without prior notice.
Presentation, Availability, and Delivery of Goods
The product range shown on Heimatkult.ch (specifications, colors, prices, availability) is generally non-binding. We reserve the right to change the product range at any time and to remove certain products completely. We accept no liability for typographical errors or incorrect or incomplete product descriptions.
We do our best to make sure the products offered on Heimatkult.ch are available. Showing a product on Heimatkult.ch doesn’t mean we guarantee it’s available. We’re only obliged to deliver products that are in stock.
If ordered products aren’t available, we might not be able to fulfill your order completely. We reserve the right to either cancel your order or deliver only part of it. In such cases, we’ll let you know. Orders are delivered by courier to the delivery address you provided during checkout, and delivery is limited to Switzerland.
Generally, orders we accept are delivered to the address given in your order confirmation. If you’re not home when your order arrives, your package will be left in your mailbox or “milk box” if possible. If the package is too big, the courier will leave you a note about what to do next. Products that can’t be delivered after three attempts will be sent back to Heimat Manufaktur AG. You can have the goods delivered again (with cash on delivery charges) or pick them up directly from Heimatkult.ch after arranging it in writing. Your obligation to pay for the goods remains. If the goods aren’t picked up within 6 months or can’t be delivered by cash on delivery, they go back into the stock of Heimat Manufaktur AG. Any refund for payments already made must be requested in writing.
In Switzerland, we waive the CHF 8.50 shipping fee for orders of CHF 80 or more. Free delivery only applies to standard shipping within 3 working days. If you use vouchers or promo codes for your purchase, the credited amount doesn’t count towards the minimum order value mentioned above.
These delivery times are non-binding and may vary. The same goes for the delivery time of day. Not meeting delivery dates does not entitle you to compensation. It’s not possible to specify a particular day or time for delivery. Liability claims regarding delivery dates are excluded.
Order Cancellation and Return Policy
You have the right to cancel your order in writing within 2 hours of placing it. If your cancellation letter crosses paths with the shipping of your order, you can still use your right of return. If you don’t, the contract is considered binding.
You can return your order within 10 calendar days from the date on the postmark or the delivery/receipt confirmation. If you can’t provide a delivery or receipt confirmation, the 10-day period starts from when the order was shipped.
The product must be returned in its original packaging, undamaged, clean, and complete. Any seal must not be broken.
Resale
Reselling or passing on goods bought on Heimatkult.ch to third parties is strictly prohibited.
Prices
All prices shown on Heimatkult.ch include VAT according to the applicable tax rates. The prices displayed on Heimatkult.ch at the time of your purchase apply.
Payments
You can pay by credit card, debit card, PostCard, American Express, TWINT, or invoice (through our external payment provider MF Group / POWERPAY). The amount will be charged to your account when your order is shipped. Once your order is being processed for shipping and the goods have been handed over to the courier, refunds are no longer possible.
To protect your personal data, we use Secure Socket Layer (SSL) encryption and other certified encryption technologies and systems.
Please note that paying by credit card may result in additional costs and fees depending on your agreement with your credit card provider.
We reserve the right to block you from future use of the website and access to Heimatkult.ch, and to delete your user account if you are in default of payment or your credit card has insufficient funds.
Offsetting outstanding payments is not allowed.
Purchase on account with installment option (POWERPAY)
MF Group / POWERPAY offers “purchase on account” as an external payment provider. With the single invoice, you can easily pay for your online shopping by invoice. If you don’t pay within the given timeframe, you’ll receive a monthly invoice with an order overview the following month.
When the purchase contract is concluded, POWERPAY takes over the invoice claim and handles the payment process. By choosing purchase on account, you accept, in addition to our terms and conditions, the terms and conditions of POWERPAY (powerpay.ch/de/agb).
Theft and misuse of delivered goods
As soon as the goods have been delivered to you or left in your mailbox or milk box, we take no responsibility in case of theft or misuse. It’s up to you to make sure the goods aren’t sold or used by anyone under 18.

If your delivery is damaged upon arrival, you can return it free of charge at your courier service location. To do this, you’ll need to fill out a return slip at the courier service.

The place of jurisdiction is the customer's place of residence, which must be in Switzerland.
