The question of whether CBD is legal to buy and use in Switzerland comes up again and again. While many European countries have restrictive limits and unclear regulations that cause confusion, Switzerland has established a comparatively liberal but clearly regulated legal framework. The legal basis: The THC limit

The key factor in deciding whether a hemp product is legal in Switzerland is the Federal Act on Narcotics and Psychotropic Substances (Narcotics Act, BetmG). The most important part here is the THC limit.

Unlike many neighboring European countries where the limit is 0.2% or 0.3% THC, the allowed limit in Switzerland is below 1.0% THC.

So, to answer the original question: CBD is legal in Switzerland as long as the total THC content is under 1.0% and the product is properly classified.

Products that fall below this threshold are not considered narcotics under the law. They are not subject to the Narcotics Act, but are instead regulated by other laws depending on their type and intended use.

History: Since when is CBD allowed in Switzerland?

The current acceptance of CBD products is the result of a longer legal development. A key milestone was the year 2011.

On July 1, 2011, the allowed THC limit in the Narcotics Ordinance was set at 1.0%. The original goal was to make it easier to grow industrial hemp and clearly distinguish it from intoxicating cannabis.

  • 2016: The first CBD flowers were registered as tobacco substitutes with the Federal Office of Public Health (BAG).
  • 2017: Introduction of tobacco tax on CBD flowers.
  • 2024: The new Tobacco Products Act (TabPG) comes into force.

Swiss cultivation and CBD flowers

A special feature of the Swiss market is the high quality of locally produced industrial hemp. CBD flowers are legally available in Switzerland as tobacco substitutes as long as the THC content is under 1.0% and all legal requirements are met.

Since October 1, 2024, the revised Tobacco Products Act (TabPG) has been in effect in Switzerland. It standardizes the rules for tobacco and plant-based smoking products and provides more legal certainty.

The most important requirements include:

  • Minimum age: Sales only to people aged 18 and over.
  • Notification requirement: Disclosure of all ingredients to the authorities.
  • Warning labels: Legally required warnings on packaging.

Alternative uses: Hemp teas

Not all hemp products are subject to the Tobacco Products Act. For hemp leaves or flowers used to make tea, the legal classification depends on the composition, intended use, and THC content.

Hemp teas are part of the traditional use of industrial hemp in Switzerland. They show the versatility of the plant, always within the framework of current legal requirements.

CBD in everyday life in Switzerland: An overview
